Welcome to the ClubNet Limited (“ClubNet”) website.

Please read these Terms and Conditions carefully. In using the ClubNet website you agree to be legally bound by these terms, which take effect immediately on your first use of the ClubNet website. ClubNet reserves the right to change these terms of use at any time and your continued use of the website following such change shall be deemed to be your acceptance of such change. If you make any purchases or accept any offers you will, in addition, be subject to the then current conditions that apply to all such purchases or offers (“conditions of sale”). You will be asked to confirm your agreement to the conditions of sale prior to making any purchases or accepting any offers. These Terms and Conditions apply to all users of the ClubNet website.

These Terms and Conditions are additional to and should be read in conjunction with the Privacy Policy.

The ClubNet website is powered by Webjam Limited, and your use of the ClubNet website is subject to your acceptance of the Webjam Terms and Conditions, as may be updated from time to time by Webjam Limited, in addition to these Terms and Conditions.

Please note that administrators for each club (“Club Administrators”) registered on ClubNet are able to access all personal information for other registered users for their club. The overall administrator of the ClubNet website (the "ClubNet Administrator") is able to access the personal information of all registered users of the website. The Club Administrators and the ClubNet Administrator are required to abide by the provisions of the Data Protection Act 1998 (see Privacy Policy). In these terms 'authorised administrator' means any person, firm, company or unincorporated association which has been granted rights by ClubNet, the ClubNet Administrator or any Club Administrator in respect of the ClubNet website.

Use of clubnet.org.uk

In consideration of ClubNet granting you access to the pages of the ClubNet website, you agree to be bound by the following terms and conditions of use:

Your Obligations

1. You must not use the ClubNet website to display or transmit any defamatory, libellous, racist, abusive, unlawful, offensive, sexually orientated, threatening, intimidating, false, misleading or obscene material or post any content which you do not have the right to use, or transmit to the ClubNet website any material containing software viruses or files designed to damage or disrupt the good working order of any computer or telecommunications equipment.
2. You agree that you are wholly responsible for everything that you transmit to the ClubNet website including but not limited to the quality or accuracy of the information. In the event that data displayed is inaccurate you may contact us using our Enquiry Form in order to communicate the inaccuracies. All inaccuracies will be corrected within a reasonable period of time from such notification.
3. You must not use any area of the ClubNet website for any commercial purpose unless approved in advance by ClubNet.
4. You agree not to impersonate any other person or entity whilst using the ClubNet website.
5. You must not attempt to interfere with the services we provide, or try to gain unauthorised access to other sites, computers or networks connected to or via the ClubNet website. In addition, unless you are an authorised administrator, you will not add or remove any links to or from the ClubNet website without the prior written consent of ClubNet.
6. You agree not to use the ClubNet website:

• to create a database (electronic or otherwise) that includes material downloaded or otherwise obtained from the ClubNet website except where expressly permitted on the ClubNet website;
• to transmit or re-circulate any material obtained from the ClubNet website to any third party except where expressly permitted by the ClubNet website;
• to use the ClubNet website in such a way that might infringe third party rights or that might bring ClubNet, any sport’s National Governing Body, any club and/or any sport into disrepute.

7. If you wish to become a member, you confirm that you are at least 18 years of age. If aged under 18 you confirm that you are accessing the ClubNet website with full parental/guardian consent. Please also get your parent/guardian's permission before providing personal information to the ClubNet website.

Right to Remove and Restrict Access

8. ClubNet, or its agents or authorised administrators, will be entitled at its discretion to remove anything which is transmitted to, from or via the ClubNet website or posted on the ClubNet website which in their opinion, does not fulfil these requirements.
9. ClubNet and/or the authorised administrator shall have the right to refuse to allow you access to any part of the ClubNet website at any time and for any reason without giving you any advance notice.

Licence

10. You hereby grant ClubNet a royalty free, perpetual, irrevocable, assignable, non-exclusive right to copy, re-publish and distribute any materials, data or other information that you submit to the ClubNet website and you will not submit any content unless you are able to grant this right.

Indemnity

11. You hereby agree to fully indemnify and keep indemnified ClubNet against all liabilities, claims, actions, proceedings, loss, damage, costs or expenses suffered or incurred by ClubNet arising out of any breach or non-performance of all or any of your covenants, representations, obligations, undertakings or agreements.

Site availability & Information on the Site

12. We cannot guarantee that you will have uninterrupted access to the ClubNet website at all times due to certain technical matters which may be beyond our control.
13. The information on the ClubNet website has been included in good faith for general informational purposes only. It should not be relied upon for any specific purpose and no representation or warranty is given as to its accuracy or completeness save where the information provided forms the basis of a specific contract with you.

We do not endorse or take responsibility for the content of those web sites, are not responsible for the availability of the web sites and will not be liable in any way for any loss or damage which you may suffer by using those web sites. Disclaimer of Warranties and Liability

15. To the fullest extent permitted by law all warranties (express or implied) in respect of the ClubNet website and the content of and your use of the same are excluded. Except in the case of death or personal injury caused by our negligence or any wilful act, to the fullest extent permitted by law we exclude all liability to you in respect of your use of the ClubNet website. The conditions of sale will apply to products and services purchased and ordered via the ClubNet website. These will be drawn to your attention where applicable.
16. The ClubNet website may contain material (including, but not limited to, advertisements) posted by third parties. Individual users and advertisers are solely responsible for the content of advertising and other material which they submit to ClubNet and/or the authorised administrator and for ensuring that such content complies with all relevant legislation. ClubNet accepts no responsibility for the content of material submitted by third parties, including, without limitation, any error, omission or inaccuracy therein.
17. Whilst effort has been taken to ensure that the ClubNet website is free from viruses, no warranties are given that they are free from viruses and users are responsible for ensuring that they have installed adequate virus checking software. Neither ClubNet nor the authorised administrator shall be liable for any viruses or any other computer code, files or programs designed to interrupt, restrict, destroy, limit the functionality of or compromise the integrity of the ClubNet website or any hardware on which they are hosted.

Variations

18. These terms may be varied from time to time. Please ensure that you review these terms regularly as you will be deemed to have accepted all variations if you continue to use the ClubNet website after a variation has been posted.

Governing Law

19. These Terms and Conditions are governed by and interpreted in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms and Conditions shall be subject to the non-exclusive jurisdiction of the English Courts. This site is operated by ClubNet Limited (registered number 05513757) whose registered address is 18 Broad Street, Ludlow, Shropshire, SY8 1NG.

Payments to Clubs and Organisations by ClubNet Limited

1. Payment of monies accrued by registered clubs and organisations for sponsorship, advertising, commission and / or other activity by the Club / Organisation as arranged through ClubNet Limited will be paid to the Club / Organisation quarterly within one month of the end of the calendar quarter (ending 31 March, 30 June, 30 September and 31 December) in which the money was earned by the Club / Organisation provided the Club / Organisation was registered with ClubNet Limited at the end of the quarter, it remains registered at the payment date, is fully up to date with all submissions, returns or other requirements relating to offers to which the Club / Organisation has opted in via ClubNet, and the balance due has reached the Payment Threshold.
2. Where ClubNet Limited is passing on commission to a Club / Organisation from a third party arrangement, ClubNet is only liable for that payment if and when they have received payment from the third party. If a third party fails to make payment, ClubNet will take all reasonable actions to secure payment but accepts no liability for any sums that ClubNet Limited is unable to recover from the designated third party.
3. Payment will be made by cheque or direct bank transfer as appropriate provided that the Club / Organisation has submitted their payment details to ClubNet online, or by letter on Club / Organisation letterhead to ClubNet Accounts, PO Box 502, Winchester, SO23 3DF. Payments will be accompanied by a statement giving details of the payment.  Payments of less than your Payment Threshold will be carried forward until the quarterly balance exceeds your Payment Threshold.  You can adjust your Payment Threshold online or by telephone.  It is set by default to £50 if you have opted for direct bank transfer ("BACS") or £100 if you have not opted for BACS payments.  There is no charge for payments by direct bank transfer. An administration fee of £2.50 + VAT will be charged for each cheque raised, and this fee will be deducted from the payment made to the Club / Organisation.
4. If the Club / Organisation is, or becomes, VAT Registered, they are responsible for informing ClubNet (via the appropriate Payment Details link above), who will require a VAT invoice to be issued by the Club / Organisation for the appropriate amount prior to making payment.
5. In the case that a Club / Organisation is not registered with ClubNet Limited but has monies accrued which have been paid to ClubNet Limited and which have reached the Payment Threshold, ClubNet Limited will attempt to contact that Club / Organisation and request that they register in order to receive the monies accrued. However, if the Club / Organisation has not signed up within 6 months of the monies being due they will revert to ClubNet Limited.
6. In the case that there are no transactions on a Club's account for a continuous period of at least 12 months, any transactions on that account may be cancelled.  At the sole discretion of ClubNet Limited, the account may be closed and the Club's registration cancelled, or the account may be allowed to remain open with a nil starting balance.

1. The ClubNet website, its design, text, graphics, illustrations and images are (unless otherwise stated) copyright of ClubNet, its Licensors or the relevant contributor. You may not copy, reproduce, republish, download, post, broadcast, transmit, adapt or otherwise use any copyright material in any way except for your own personal non-commercial use.
2. All brand, product and service names used in the ClubNet website are (unless otherwise stated) the trade marks, trade names or service marks of ClubNet or the parties to whom they refer. You may not distribute products or offer services under or by reference to or otherwise use or reproduce any such trade marks, trade names or service marks without the prior written permission of ClubNet or the owner of such trade marks, trade names or service marks.
